These Terms of Service ("Terms") govern your use of the website getziviro.com and the services provided by Ziviro LLC ("Ziviro," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.
1. Description of Services
Ziviro provides automated missed-call text-back and lead qualification services for home service businesses. Our system detects missed inbound calls to a client business, sends an automated SMS to the caller on behalf of the business, conducts an AI-powered SMS conversation to qualify the lead, and schedules estimate appointments on the business owner's calendar.
Ziviro is a lead recovery service. We do not generate leads, provide marketing services, answer calls live, or guarantee any specific number of leads or revenue outcomes.
2. Eligibility
Our business services are available to legally operating businesses in the United States. You must be at least 18 years old and authorized to act on behalf of the business to enter into a service agreement with Ziviro.
3. SMS Messaging Consent
By calling a business that uses Ziviro's services, you may receive automated SMS messages in response to your missed call. These messages are transactional — they respond to your initiated call and are sent on behalf of the business you contacted.
You can opt out of receiving messages at any time by replying STOP to any message. Standard message and data rates may apply. Message frequency varies by conversation.
4. Acceptable Use
When using our website or services, you agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to interfere with, disrupt, or compromise the integrity of our systems or infrastructure.
- Send spam, unsolicited messages, or use the service for purposes other than responding to legitimate business inquiries.
- Misrepresent your identity or affiliation with a business.
- Use the service to harass, threaten, or send abusive messages to any person.
5. Client Obligations
Business clients who subscribe to Ziviro's services agree to:
- Ensure that all callers to their business number are legitimate business contacts who have initiated communication.
- Comply with all applicable laws regarding customer communications, including the Telephone Consumer Protection Act (TCPA).
- Provide accurate business information for system configuration.
- Not use the service to send marketing or promotional messages beyond responding to missed calls.
6. Service Availability
We strive to maintain reliable service availability but do not guarantee uninterrupted operation. Our service depends on third-party platforms (including SMS carriers, GoHighLevel, and Twilio) that may experience outages beyond our control. We are not liable for service interruptions caused by third-party outages, carrier filtering, or force majeure events.
7. Payment Terms
Business clients agree to pay fees as specified in their individual service agreement. Founding client pricing is $497 one-time setup fee plus $297 per month for a 6-month founding term. Payment terms, billing dates, and refund policies are detailed in each client's service agreement.
8. Limitation of Liability
To the maximum extent permitted by law, Ziviro LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. Our total liability for any claim related to our services shall not exceed the total amount paid by you to Ziviro in the three (3) months preceding the claim.
Ziviro does not guarantee that our services will result in any specific number of leads, appointments, or revenue. Results depend on the client's existing call volume, service quality, and market conditions.
9. Intellectual Property
All content on getziviro.com, including text, graphics, logos, and software, is the property of Ziviro LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.
10. Termination
We reserve the right to suspend or terminate access to our services for any user or client who violates these Terms. Business clients may terminate their service agreement according to the terms specified in their individual agreement.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the courts located in Montgomery County, Pennsylvania.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. For business clients, material changes to service terms will be communicated via email with at least 30 days notice.
